General Information and Rules/Regulations for Programming
- All applications must address logistics as requested (i.e., description, dates, times, deadline, etc). A general template will be provided.
- Submission of this application is not confirmation that your class has been approved.
- Classes will not be held on school observed holidays.
- Additional classes beyond what is advertised in the brochure will not be permitted without authorization.
- Classes that are cancelled due to low enrollment for two consecutive sessions may no longer be offered.
- The Instructor Agreement is not an employment agreement. There are no benefits or salaries paid by our department.
- The Recreation Department will handle all registrations for classes. Instructors are not permitted to collect fees under any circumstances.
- It is required that all instructors, subcontractors, volunteers, and assistants pass a criminal background check.
- Instructors must obtain written permission from our department prior to assigning subcontractors, and said subcontractors must pass a criminal background check.
- Instructors and independent contractors will not discriminate against any employee, volunteer, participant or student due to race, creed, color, national origin, sexual orientation, physical or mental handicap, marital status, veteran status or age.
- Instructors who elect to rent space over a contractual split must procure and maintain occurrence-based Commercial General Liability and Product Liability Insurance (COI), when required, in an amount no less than Four Hundred Thousand Dollars ($400,000.00) per occurrence for bodily injury, death and property damage. COI must name the Town of Scarborough as an additional insured party, or instructor may obtain a general liability extension endorsement, for coverage only in those areas where government immunity has been expressly waived by 14 M.R.S. A. § 810-A, as limited by § 8104-B, and § 8111. The terms of this contract and the insurance coverage shall not be deemed a waiver of any defenses, immunities, or limitations of liability or damages available to the Town under the Maine Tort Claims Act, other Maine statutory law, judicial precedent, common law, or any other defenses, immunities or limitations of liability available to the City. You shall also be responsible for any and all deductibles and/or self-insured retentions.
